KDM going to court over KwaDukuza Mall

After delaying the construction of the R1.5 billion KwaDukuza mall and recreation centre, a member of the Concerned Citizen Group (CCG) is again challenging KwaDukuza Municipality over the sale of the KwaDukuza Recreational Ground and Golf Course.

Despite having lost one high court application earlier this year, KwaDukuza businessman Cassim Mohamed Moola wants the municipality to set aside the sale of the grounds and golf course.

Moola had forwarded a review application for the sale of the grounds to the Pietermaritzburg High Court for hearing on October 11.

The CCG took KDM and Double Ring Trading, a company owned by Vivian Reddy, to court In February 2017 asking for an interdict to prevent construction of the mall, alleging that the tender process was conducted unfairly.

Moola claimed the municipality invited developers to partner with KDM in developing the property and it did not say the property was for sale.

This second application is by Moola alone as other CCG partners say they cannot afford the legal cost.

He claims that Reddy is using the development as a cover-up for a casino and says the town would lose valuable sporting facilities. CCG lost the court case and Reddy is suing CCG for R28 million in damages.

Reddy has brushed aside this latest approach to court. He said the construction of the mall continues and he is not concerned with Moola’s weak court attempt.

“He is a businessman who has shops in the town. They will be defeated again,” said Reddy.

KDM media liaison officer Sipho Mkhize, said the matter is sub judice and the municipality is in the process of filing its papers and replying affidavits.

He pointed out that the CCG’s first application had been dismissed with costs and KDM had approved the transfer.

“The municipality has transferred the property to Double Ring Trading on conclusion of the case,” said Mkhize.
