Are you monitoring your levy account?

Have you ever received your levy account, and the figures just don’t add up?

There is a general misconception on charges which can be raised on to an owners levy account.

Here are the additional charges that can be added on to an owner’s levy account should they not be careful, as well as the documents needed in order to protect yourself:

Fines

The only way fines can be charged to owners is when all the following boxes have been ticked:

  • Do the Approved Conduct Rules include a provision for fines to be raised?
  • Did the owner get a warning and that a fine will be implemented?
  • Did the owner get the opportunity to explain themselves before being fined?
  • Is the fine reasonable?

Expense recovery

The following documents must be readily available:

  • The minutes of the meeting – signed by the Chairman
  • Proof to the owners stating the amount of the expense and what it is in respect to
  • The resolution by the trustees confirming the decision made
  • The amount of the expense – amount to be split in a schedule should there be multiple owners.

Maintenance recovery when owner failed to maintain

The following documents must be readily available:

  • Request(s) to the owner to do the necessary maintenance
  • Resolution taken by the Trustees to do the repairs after the owner failed to do so within a certain period from the time he has been requested to do so;
  • Quotes obtained and sent to the owner for the owner to attend to within a certain period of time and notification to the owner that if he/she fails to affect the necessary maintenance within a specific period of time then the Body Corporate will attend to the repairs/ maintenance and the costs will be allocated to the owner’s levy account.
  • Final letter to the owner stating he/she failed to attend to the necessary maintenance timeously and as a result the costs of the Body Corporate attending to same will be allocated to the levy account together with the invoice paid by the Body Corporate;

Special levy

The following documents must be readily available:

  • The minutes of the meeting – signed by the Chairman
  • The circular to the owners
  • The schedule per PQ
  • The resolution signed by at least two trustees

Levy increase

The following documents must be readily available:

  • The circular to the owners
  • The schedule per PQ
  • The resolution signed by at least two trustees

All of the above is needed when the collection of the levies goes to court and all complexes are required to produce these documents on request.
